Inquiry into the City of Perth

The Inquiry Into the City of Perth was announced on 24 April 2018 by the Minister for Local Government David Templeman under section 8.16 of the Local Government Act 1995.

Mr Tony Power was appointed to conduct the Inquiry and will investigate and report on the operations and affairs of the City of Perth. The Inquiry will have the powers of a Royal Commission and will discharge its role independently and objectively.

About the Inquiry Panel

Portrait of Tony PowerThe single member Panel is Mr Tony Power, a senior and experienced barrister.  Mr Power has a broad practice and has worked in many areas of the law in almost all Courts and Tribunals, the Corruption and Crime Commission, Royal Commissions and as a mediator.  He has been an acting Judge of the District Court and is an adjunct Professor at the University of Notre Dame Australia and Murdoch University.

The Inquiry will have the powers of a Royal Commission and the authority to make a recommendation on the dismissal or reinstatement of the suspended City of Perth council. In undertaking the Inquiry, Mr Power will investigate the operations and affairs of the City of Perth between October 1 2015 and March 1 2018 inclusive. Specifically, the Inquiry will consider if there was a failure to provide good government for the City of Perth community, the prospect of providing future good government and any necessary action to ensure ongoing good government.

November 2018 hearing

On 24 April 2018 the Minister for Local Government, using his powers under Section 8.16 of the Local Government Act 1995, appointed an Inquiry Panel (Inquiry) to inquire into, report on, and make recommendations in relation to the City of Perth, including whether the Council should be reinstated or dismissed.

A hearing took place on 21 November 2018 at which the Inquirer and Counsel Assisting will open the Inquiry to the public. The purpose of the opening was to ensure that members of the public are properly informed about the nature and extent of the Inquiry, its functions, progress and some of its likely directions. This opening preceded, among other things, a number of private examinations of various persons connected with the affairs of the City of Perth who are expected to be able to assist the Inquiry in comprehensively addressing its Terms of Reference​.
